Terms of Use for the "MUJI app HK & Macao" Application Services

Article 1: Purpose

These Terms of Use are established by MUJI (Hong Kong) Company Limited (hereinafter referred to as the "Company" or "we") and govern the services provided to users in Hong Kong and Macao through the "MUJI app HK & Macao" mobile application (hereinafter referred to as "MUJI app"). By using these services (hereinafter referred to as the "Services"), users agree to be bound by the following terms and conditions including any future changes (hereinafter referred to as the "Terms") and comply with them.

Article 2: Definitions

The definitions of terms used herein are as follows:

2.1 "User" (or "You") refers to the holder who downloads the MUJI app, including "MUJI Members" and users who use the MUJI app as guests.

2.2 "Member" (i.e. "MUJI Member") refers to members of the MUJI app program.

2.3 "Points" (i.e. "MUJI Points") refer to reward units granted by the Company to Members for downloading or using the MUJI app when making purchases at MUJI stores in Hong Kong and Macao, dining at Café&Meal MUJI, shopping at the MUJI Official Online Shop in Hong Kong, or engaging in mobile interactions.

2.4 "e-Cash Voucher" refers to an electronic cash voucher redeemed with Points, which can be used for purchases at MUJI stores in Hong Kong and Macao. It is not exchangeable for cash nor applicable to use for purchases at MUJI Official Online Shop. The use of e-Cash Voucher is subject to relevant terms and conditions (if any).

2.5 "Points Expiry Date" refers to the final date by which Points must be used. The details are explained in Article 4.7.

2.6 "e-Cash Voucher Expiry Date" refers to the final date by which the e-Cash Voucher must be used. The details are explained in Article 4.7.

2.7 "Birthday Privilege" refers to benefits that members can enjoy in their birth month while using the MUJI app. To receive this benefit, Members must provide their birth month within the MUJI app. Birthday Privileges currently offered is to grant double Points on the first purchase made during the birth month, with a maximum of 5,000 points ("Birthday Bonus Points"). The earned Points will be issued on the last day of the month following the birth month.

2.8 "User Information" refers to the relevant information provided by the User when using the Services or collected by the Company in accordance with these Terms (including the User's personal data).

2.9 "Hong Kong" refers to the Hong Kong Special Administrative Region.

2.10 "Macao" refers to the Macao Special Administrative Region.

Article 3: MUJI app Membership Registration

3.1 To register as a MUJI app Member, applicants must:

3.1.1 Be at the age of 18 or above. If the applicant is under 18, they must obtain prior consent from their parent or guardian and ensure that their parent or guardian agrees to the applicant using the Services and becoming a MUJI app Member under these Terms.

3.1.2 Install the MUJI app on their mobile device, complete the required fields in the MUJI app's membership registration form, and agree to the Terms by clicking the confirmation button; or complete the required fields in the registration form on the MUJI app website and agree to the Terms by clicking the confirmation button.

3.1.3 Register with a valid mobile phone number from Hong Kong or Macao, as well as a valid email address. Each person can only register for one MUJI app account, and each mobile phone number and email address can only be used to register for one MUJI app account. Duplicate applications will not be accepted.

3.2 Users warrant and declare that the information provided during MUJI app membership registration is true, accurate, complete, and up-to-date. The birth month provided at the time of registration will be used to enjoy the Birthday Privilege in accordance with Article 2.7 of these Terms. Each MUJI app Member is entitled to enjoy the Birthday Privilege only once per year. Once registration is completed, the birth month information cannot be changed.

3.3 If there are any changes to the information submitted during MUJI app membership registration (except for the birth month), the Member agrees to immediately update the information in their account profile in the MUJI app. To the extent permitted by law, the Company is not responsible for any claims, demands, liabilities, or legal actions arising from the User's failure to provide updated information or any inaccuracies or incompleteness in the submitted information.

3.4 MUJI app Members can start earning Points after successfully completing the membership registration process.

3.5 The Company reserves the absolute discretion to refuse or revoke any applicant's/MUJI app Member's membership registration and to terminate or cancel their MUJI app account without prior notice.

Article 4: Points and e-Cash Voucher Issuance, Usage, and Expiry

4.1 We offer the Points to Members according to the prevailing Services mechanism based on their purchases at MUJI stores in Hong Kong and Macao, as well as the MUJI Official Online Shop in Hong Kong, dining at Café&Meal MUJI, or participating in other approved activities (e.g., shopping, dining, engaging in services or interactive activities, unless otherwise specified). Points cannot be accumulated or used for purchases outside of Hong and Macao. Additionally, Users cannot check product stock availability in MUJI stores outside Hong Kong and Macao.

4.2 Members earn 1 point for every HK$1 spent at MUJI stores in Hong Kong or the MUJI Official Online Shop. Similarly, Members earn 1 point for every MOP$1 spent at MUJI stores in Macao.

4.3 Points can be redeemed for e-Cash Vouchers at the following rates by the Point Expiry Date:

Points cannot be exchanged for cash or directly used as a cash discount at checkout. We reserve the right to review and change the Point redemption mechanism with reasonable prior notice to Members.

4.4 Points cannot be earned on transactions at Coffee Stand, purchases at MUJI Community Market stalls, payment for fees for any workshops or activities, and/or any other specified spendings or services, including deposits, service fees (unless otherwise specified), and plastic or paper bag charges.

4.5 If a Member receives a refund for a purchase, service, or dining transaction, the Points earned from such transaction will be deducted from the Member's account immediately.

4.6 Points cannot be earned in case of exchanging an item for another of the same value. If a Member pays the price difference to exchange for a higher-value item, further Points are then granted based on the price difference.

4.7 Points are issued on an annual basis, starting from January 1st at 00:00 until December 31st at 23:59 of the same year. Points earned within a given year must be used by August 31st at 23:59 of the following year (i.e. Point Expiry Date); otherwise, they will expire and be reset. Unless otherwise specified, e-Cash Vouchers must be used within 90 days from the issuance date (i.e. e-Cash Voucher Expiry Date); otherwise, the Points will be invalid afterwards.

4.8 The Company reserves the right to deduct Points if a Member returns purchased goods, cancels services, or cancels dining transactions for which Points were earned.

4.9 The Company may periodically offer special privileges to Members. The details of such offers will be published on the official MUJI website.

4.10 Points or e-Cash Vouchers can be used for purchases at all MUJI stores in Hong Kong and Macao or dining at all Café&Meal MUJI. To use Points or e-Cash Vouchers, Members must present their mobile device with the MUJI app installed at checkout and inform store staff of their intention to use Points or e-Cash Vouchers. Points and e-Cash Vouchers cannot be used for purchases at any specified channels or third-party online platforms, or ordering catering services.

Article 5: Prohibition of Merging Points

5.1 Members' accumulated Points cannot be shared, merged, gifted, lent, pawned, or transferred to other Users.

5.2 Points accumulated through other overseas versions of the MUJI app, other mobile applications, or membership programs under the same corporate group cannot be used at the Company's stores, nor can they be merged or used in conjunction with points earned under the Services.

Article 6: Deduction, Expiry, or Cancellation of Points and e-Cash Vouchers

In any of the following situations, the Member's Points or e-Cash Vouchers will be automatically or partially/fully deducted, become invalid, or be canceled by the Company. The Company is not responsible for any compensation or reimbursement for any Points or e-Cash Vouchers so deducted, expired, or canceled.

6.1 Failure to use Points by the Point Expiry Date or failure to use e-Cash Vouchers by e-Cash Voucher Expiry Date.

6.2 The Company terminates the Member's use of the Service as stipulated in Article 9.2.

6.3 The information submitted by the Member to the Company is false, incorrect, or contains unlawful content.

6.4 The Member obtains Points or e-Cash Vouchers through improper means.

6.5 The Member violates these Terms.

6.6 The Company, at its sole discretion, determines that the granted Points or e-Cash Vouchers should be canceled.

6.7 The MUJI app account is deleted by the Member or is canceled/terminated under the circumstances described in Article 10.

Article 7: Methods of Notifying Members

7.1 When the Company needs to notify Members, it may do so through individual notifications or by other means deemed appropriate by the Company.

7.2 If the content to be notified has been publicly announced on the Company's official website, it will be considered as having been communicated to the Member.

Article 8: Agreement to the Terms

By downloading or using the MUJI app, Users of this Service agree to be bound by and comply with these Terms. If you do not agree to these Terms, you should delete the MUJI app before using the Service, following the designated procedure.

Article 9: Activation and Termination of Service

9.1 To use this Service, Users must download the MUJI app.

9.2 If the Company has reasonable grounds to determine that any of the following situations have occurred, the Company has the absolute right to terminate the User's access to this Service without prior notice:

9.2.1 The User engages in inappropriate behavior toward this Service or any other services or systems provided by the Company.

9.2.2 The User has previously engaged in inappropriate behavior toward this Service or any other services or systems provided by the Company.

9.2.3 The User downloads the MUJI app using another person's device or a device obtained through illegal means.

9.2.4 The User violates any provision of these Terms.

9.2.5 The Company, at its sole discretion, determines that the user is unsuitable to use this Service.

9.3 The Company is not liable for any losses or damages suffered by the User or any third party due to the situations listed above.

Article 10: Immediate Termination and Cancellation of User Eligibility

10.1 The Company has the absolute right to suspend or cancel a User's access to this Service without prior notice if any of the following situations occur:

10.1.1 If a MUJI app Member account has no purchase records for 36 consecutive months, the account will be canceled without prior notice.

10.1.2 Violation of any provision under Article 9.2.

10.1.3 Illegal use of this Service or inducing others to use this Service illegally.

10.1.4 Alteration of information provided by the Company without its consent.

10.1.5 Use of this Service for unlawful purposes or inducing other users to use this Service illegally.

10.1.6 Engaging in improper or fraudulent activities.

10.1.7 Any behavior deemed inappropriate by the Company, at its sole discretion.

10.2 If a user's MUJI app account is canceled or terminated for any reason, all records in the account will be deleted, and any accumulated Points, unused e-Cash Vouchers, or rewards will immediately become invalid without reissuance or refund.

10.3 In case of any disputes regarding Points or the use of this Service, the Company reserves the final decision and has the absolute discretion to restrict or suspend a User's access to this Service.

10.4 If a User is unable to use this Service due to any of the above situations, the Company bears no responsibility and is not required to provide an explanation. If any of the above situations cause losses, damages, or costs (including but not limited to legal fees) to the Company or any third party, the User shall be liable for compensation.

Article 11: Mandatory Suspension or Termination of Service

11.1 The Company may suspend or terminate part or all of the Services without prior notice under the following circumstances:

11.1.1 Regular or urgent maintenance, inspection, repair, or updates of the system of the Service.

11.1.2 Natural disasters such as fire, power outages, earthquakes, volcanic eruptions, floods, or tsunamis, or any situation beyond the Company's reasonable control.

11.1.3 War, disorder, riots, or similar situations.

11.1.4 System failures, tampering, interference (including data or source code breaches), or network connection failures.

11.1.5 Any other situation where the Company deems it necessary to suspend or terminate the Service.

11.2 The Company is not responsible for any losses or damages suffered by Users or third parties due to the above circumstances.

Article 12: Discontinuation of Use

12.1 Users may stop using the Service at any time. Upon discontinuation, all accumulated Points, e-Cash Vouchers, and associated rights and benefits will immediately become invalid. The Company is not liable for any compensation after a User discontinues the Service.

12.2 In the event of a User's death, the Service will be considered discontinued.

Article 13: Prohibition of User Identity Transfer

13.1 Users are not allowed to lend, transfer, or loan their identity to any person, company, or organization. The Company is not liable for any losses or damages caused by such actions.

13.2 If such actions result in losses, damages, or costs (including but not limited to legal fees) to the Company or any third party, the User shall be liable for compensation.

Article 14: Personal Data Security

Users are responsible for protecting the security of their login credentials and passwords or any other personal data when downloading or using the MUJI app. If a User's device or Service is misused due to intentional or negligent actions, leading to losses or damages to the user or third parties, the Company is not liable for any compensation.

Article 15: Deemed Proper Notification

15.1 Users should regularly check the Company's official announcements and information related to the use of this Service through this Service.

15.2 If a User fails to provide the required information or provides incomplete information, resulting in delays or failure to receive notifications or promotional offers, such notices will still be considered properly delivered. The Company is not responsible for any losses or damages resulting therefrom.

Article 16: Prohibited Activities

The following activities are strictly prohibited when using this Service:

16.1 Using this Service for unlawful activities or for profit-making purpose.

16.2 Infringing or potentially infringing on the trademark rights, copyrights, patents, or other intellectual property rights and rights of the Company, its business partners, or third parties.

16.3 Violating the properties, privacy, or other rights of the Company, its business partners, or any other third parties.

16.4 Having acts of discriminating against third parties, or defamation, or damaging the reputation or credit of others.

16.5 Committing any acts that colludes or may collude with others in fraudulent or similar criminal activities.

16.6 Transmitting, publishing, distributing or releasing any contents (including images or texts) which are obscene, related to child pornography, child abuse or similar content.

16.7 Establishing any pyramid schemes or inducing others to join or promotion such scheme in improper way.

16.8 Modifying or deleting any data of the Company or any other third party through the use of the Service.

16.9 Pretending or impersonating a real or fictitious third party while using the Service.

16.10 Transmitting harmful computer programs or infringing or violating others' privacy.

16.11 Conducting pre-election activities, political campaigns activities or similar acts, and any acts violating relevant laws.

16.12 Sending any unsolicited emails for advertisements, promotions or marketing etc. or any emails which contain or may contain unethical contents or requesting others to forward a chain letter or acceptance to such request.

16.13 Illegally intruding into facility of any third-party or the facility used for services operated by the Company (referring to communication systems, computers, other devices, and software prepared by the Company but yet used for providing services), with the intent to or attempting to use, interfere with, or disrupt operations.

16.14 Collecting any information related to any third-party without his/her consent or through fraudulent means.

16.15 Committing any other unlawful or unethical acts, or acts that disrupt the operation of the Service, acts that injure the reputation or property of the Company, or any other acts that harm the Company or third parties.

16.16 Encouraging any of the above acts (including allowing, persuading, tolerating any party to commit such kind of acts).

Article 17: Changes to This Service

17.1 Users agree that the Company may, from time to time without prior notice, change, update, or revise the Terms, rules, or content of this Service. Such change, update or revision include but not limited to termination of all or any part of the Service or contents of MUJI app and/or prices of products / services which are stated as "available" in the Service.

17.2 The Company is not liable for any disadvantages or losses caused by these changes.

17.3 The Company reserves the right to update, modify, discontinue, or impose restrictions on its use at any time without obligation or liability.

Article 18: Proprietary Rights

The content of this Service and MUJI app, including text, graphics, images, music, logos, interface components, trademarks, and other materials (collectively referred to as "Materials"), is owned by the Company, its affiliates, content providers, or customers and is protected by applicable laws. Users may not modify, copy, reproduce, publish, sell, or distribute any Materials without prior written consent from the Company.

Article 19: Disclaimer

19.1 Users assume all risks associated with using the Service and MUJI app. The Company is not responsible for any losses or damages resulting from User's use of the Service, the Company's deletion of the User Information, suspension of User's eligibility, or service suspension / interruption / termination of the Service, nor shall it bear any liability for compensation arising from such losses and damages.

19.2 All features and specifications of product described through the Service or MUJI app are subject to change, at any time without prior notice. Product images and availability information shown there are for reference only. Size, volume or measurements are approximate. All prices shown are regular retail prices unless specified otherwise. Products with available stocks shown may be sold out in stores. Please contact MUJI stores for product details, prevailing price and the latest offer and product availability.

19.3 The Company is not obliged to monitor content posted or made by any Users. If the Company is of its opinion that any of such content violates these Terms or is otherwise objectionable, the Company reserves the right to reject, remove, or delete it without notification. Users shall bear all risks for their use of such contents.

Article 20: Handling of Violations

If a User violates Article 10 or any other terms hereof, causing losses and damages to the Company or third parties, the User shall indemnify and hold the Company and such third parties harmless for any claim arising from such losses and damages, including but not limited to legal fees.

Article 21: Scope, Additions, and Amendments

21.1 If the Company publishes any individual term(s) related to the Service on the Company's official website or by any other means or notify User any terms in addition to these Terms, such terms shall form part of these Terms. In case of inconsistencies, such individual and additional terms take precedence.

21.2 The Company may at its sole discretion revise these Terms from time to time without User's consent and provide the Service according to the revised Terms of Use. Unless otherwise specified by us, the revised Terms become effective upon publication on the official website.

Article 22: Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the non-exclusive jurisdiction of Hong Kong courts.

The Contracts (Rights of Third Parties) Ordinance (Cap. 623) does not apply to these Terms under all circumstances.

Article 23: Language

In case of any discrepancy between the Chinese and English versions of these terms and conditions, English version shall prevail.

Unless the context has different requirements, singular words in the Terms contain plural meanings and vice versa; words of a gender include other gender.
